| INTRODUCTION | ||||||

Since April 2011 the business has been relocated to northern New South Wales in Australia. Our ABN (Australian Business Number) is 739 6271 8039. We offer financial protection to travellers booking with us by participating in the Australian 'Travel Compensation Fund' and are licenced by Fair Trading NSW (Travel Licence No. 2TA0875). NOTE: Truly Australia feels that an e-commerce
trading environment, it is helpful to outline its own role and to set
out some of the likely conditions that operators/third parties impose.

| TOUR OPERATOR / THIRD PARTY BOOKING CONDITIONS | ||||||
| Clients booking travel arrangements
through Truly Australia should be aware that the specific Booking
Conditions of relevant ground operators/third parties will normally
apply to the booking. Any unusual conditions will be highlighted by
Truly Australia before the booking is confirmed. Although Booking Conditions do vary amongst operators/third parties, in broad terms the key elements are usually similar, in that: * a non-refundable deposit is required when booking; unless otherwise stated this will be 10% of the tour price (PLEASE * the balance is normally payable 2 months before the first arrangement booked through Truly Australia commences * amendment fees and/or cancellation fees apply to any changes made by clients - also see below regarding 'Refunds' * personal travel insurance is normally recommended to be taken out by clients making a booking and some operators/third parties may require an 'Insurance Disclaimer Form' to be completed if you have arranged your own travel insurance. |

CANCELLATIONS |
||||||
| If you or anyone on your holiday booking decides to cancel the holiday you must notify us of the decision as soon as possible. Any notification
of cancellation must be in writing by Email. Cancellation will take effect from the day
that we receive your Email confirmation is received by us within 24 hours of the original notification. The following scale of cancellation charges will be payable depending on when the notification of cancellation is received, UNLESS we tell you at the time of booking that local operator/third party cancellation rules apply (and inform you just what these local operator/third party cancellation rules are): |

| TRAVEL INSURANCE: We would strongly recommend that you make your own arrangements take out appropriate travel insurance, which will in most cases include cover, under certain circumstances, against loss of deposit or cancellation fees. | ||||||
|
OUR RESPONSIBILITY |

| In the unlikely event that tour operators/third parties materially alter any arrangements booked by Truly Australia, we will do all that is reasonably possible to assist, including, where relevant, trying to find alternative arrangements to those arrangements which have been materially altered. However Truly Australia does not manage, control or operate any of the services featured on this website and therefore assumes no responsibility for any loss, damage, accident, injury, death, delay or irregularity which may be caused by or at any of the services booked by us. Truly Australia accepts responsibility for its own errors or omissions and will deal promptly and correctly with any such rare incidences. | ||||||

PAYMENT: DEPOSIT and BALANCE |

| Unless otherwise stated at
the time of booking**, Truly Australia will normally require a 10%
deposit on confirming a booking with the balance normally payable two
months before the booked arrangements commence - bookings made within
two months of departure will need to be paid in full at the time of
booking. Please note that certain arrangements do require payment in full at the time of booking. CHOICE OF PAYMENTS: 1. Normally payments need to be made direct into our Australian Dollar (AUD) bank account with the National Australia Bank (NAB) in Australia (you will be provided with details when a booking is made). 2. Alternatively you can pay by credit card (Visa or Mastercard). If you choose this method we will send you an invoice with a secure link to PayPal - but we will add 3% to the cost to be paid |

REFUNDS |
||||||
| The specific refund
policies of the relevant ground operators/third party will normally
apply to each individual component of each booking with Truly Australia.
Once travel commences there will be no refunds whatsoever for any unused
arrangements which have been prepaid to Truly Australia. Dependent on the relevant operator/third party Terms and Conditions, this 'no refund' situation may apply to a set period of time prior to the commencement of each travel arrangement that has been booked by Truly Australia. |

| The suggested holiday itineraries and
other information included within this website have been obtained in
good faith by Truly Australia from information made available, directly
or indirectly, by operators/third parties. Wherever practical, Truly
Australia will try and check the accuracy of the information supplied,
however we make no representations or warranties of any kind, express or
implied, as to the accuracy or completeness of such information, content
and its fitness for a particular purpose. All travel arrangements,
prices and other products and services shown on this website are subject
to availability. In some instances the travel arrangements set out on
this site may have to be modified to suit certain circumstances - in
particular, transportation schedules may alter or vary from day to day.
Normally, the travel contract that clients ultimately enter into, will be between such clients and the relevant operator/third party (see Booking Conditions above). Truly Australia will act only as an agent for the operator/third party and shall not be a party to that contract and shall have no involvement in the performance of that contract. Any exceptions to this will be advised to clients before booking. In the event of non-performance or mis-performance by an operator/third party the client must pursue any remedy direct with the operator/third party. |

FORCE MAJEURE |

| Neither Truly Australia nor its supplier operators/third parties can accept responsibility or offer compensation where the performance of contractual obligations is prevented by circumstances amounting to what is normally considered 'force majeure'. | ||||||

FLIGHT CONNECTIONS / SCHEDULE CHANGES |

| Truly Australia does not sell
scheduled flights. It is the clients' responsibility to make sure that the
flights reserved connect with the land arrangements booked. Truly
Australia cannot take any responsibility for the correctness of timings
of these flights including any schedule changes made by airlines after
booking. Nor can Truly Australia take any responsibility for any flight
or other delays which may result in clients missing their booked land
arrangements. Although we will always do our best to assist clients who
have made errors in booking their flights, or who have suffered schedule
changes or delays, the Booking Conditions of the relevant Australian
ground operators will still normally apply. Truly Australia cannot take any responsibility for any flight schedule changes or delays, although we would always do our very best to assist clients should these circumstances arise. |

SPECIAL REQUIREMENTS |

| Any special requests should be given in writing at the time of booking, usually by notation on the operator's Booking Form. Truly Australia and its suppliers cannot guarantee that any such requests will be met, and failure to do so will not be a breach of contract | ||||||

AUSTRALIA ENTRY REQUIREMENTS |
||||||
| Visitors to Australia require a visa to
enter the country. Normally this is an Australia tourist visa
(Electronic Travel Authority/ETA or E-Visitor visa) which can be obtained direct from the
Australian Government on the following website - www.eta.immi.gov.au All clients booking with Truly Australia are responsible for obtaining an appropriate visa to enter Australia. |
